Status: Draft for counsel review
Effective date: [EFFECTIVE DATE]
These Worker Terms apply when an adult employee or independent contractor (“Worker”) uses Jannie at the invitation of the business that employs or engages the Worker (“Company”). Jannie means [JANNIE LEGAL ENTITY NAME].
1. Relationship among Worker, Company, and Jannie
The Company—not Jannie—hires or engages the Worker and controls work assignments, classification, schedules, supervision, pay, taxes, discipline, and termination. Jannie is operational software and is not the Worker’s employer, joint employer, staffing agency, payroll provider, tax adviser, or representative.
Nothing in these Terms waives wages, reimbursement, privacy, labor, discrimination, leave, safety, organizing, or other rights that cannot lawfully be waived. A missing or disputed Jannie record does not decide whether work occurred or compensation is due; the Worker must raise that issue with the Company.
2. Account and truthful information
The Worker must use only their own account, protect their PIN or credentials, and provide information they reasonably believe is accurate. The Worker must promptly update incorrect contact or bank information and report suspected unauthorized access.
Jannie may store tax-profile fields entered by the Worker, but those fields are not a completed, certified, or filed W-9, W-4, I-9, 1099, or other tax or employment form. The Company is responsible for obtaining and filing required documents.
3. Attendance and evidence
At Company direction, Jannie may record clock-in and clock-out time, point-in-time GPS coordinates, accuracy, assigned location, status, and evidence photographs. GPS is requested only when the Worker initiates clock-in or clock-out; Jannie does not continuously track the Worker.
If required GPS permission or evidence is not provided, the digital attendance action cannot be completed. The Worker must contact the Company. Jannie does not decide whether the Worker may work or how the Company responds.
Evidence photographs should show only the worksite, arrival condition, completed work, receipt, or ticket requested by the Company. The Worker must avoid faces, bystanders, identity documents, private papers, payment cards, license plates, computer screens, health information, and unrelated personal information.
4. Bank information and NACHA files
If the Worker enters bank information, Jannie stores it for the Company’s direct-deposit process and may place it in a NACHA-formatted file generated for Company review and download. Jannie does not send the file to a bank, calculate the Worker’s pay, initiate a transfer, hold funds, or guarantee deposit timing. The Company is responsible for payment and correction of errors.
Bank information should be submitted only through designated secure fields, never through notes, photographs, support messages, or AI prompts.
5. Privacy
The Privacy Policy and the Company’s workforce notice explain data use. For workforce records, the Company determines the business purpose and Jannie processes information to provide the service. Requests to access or correct employment, attendance, tax, or payment records should be directed first to the Company.
6. Prohibited conduct
The Worker may not impersonate another person; clock in or out for another person; falsify location, time, evidence, or records; share credentials; upload malicious or unlawful content; access another organization’s data; or include restricted sensitive information in an AI prompt.
7. Service limitations
Jannie may be unavailable or contain errors. The Worker should promptly notify the Company of failed, missing, or incorrect records. Jannie is not responsible for the Company’s employment, tax, payment, scheduling, assignment, or disciplinary decisions.
8. Suspension
Jannie or the Company may suspend access for suspected misuse, security risk, account termination, or legal reasons. Suspension does not determine Worker status or eliminate the Company’s obligations.
9. Governing law
These Terms are governed by Florida law to the extent permitted, without limiting nonwaivable protections that apply where the Worker performs work. [COUNSEL: confirm dispute language and avoid conflicting with Customer employment agreements.]
10. Acknowledgment
By selecting “I agree” or using the Worker experience, the Worker acknowledges receiving these Terms and the Privacy Policy. Separate acknowledgments are required for precise location and banking/direct-deposit information.
